Avatte, a service provided by Yapan, Inc. ("Avatte," "we," or "us"), values your privacy and is dedicated to safeguarding it in accordance with this Privacy Policy. This Privacy Policy forms an integral part of Avatte's Terms and Conditions, available at https://avatte.me/tos.html, as they may be updated periodically ("Terms"). Any capitalized terms used but not defined in this Privacy Policy shall have the meanings assigned to them in the Terms.

This Privacy Policy outlines the types of information we may collect from you or that you may provide when you visit our stores, kiosks, offices, and scanning sites in person (collectively, the “Avatte Sites”) or access Avatte’s website at https://avatte.me (the “Avatte Website”), as well as when you communicate with us. It also explains our practices for collecting, using, maintaining, protecting, and disclosing this information.

This Privacy Policy governs the information we may collect at the Avatte Sites, through your use of the Avatte Website, and via email, text, and other electronic communications between you and us. The Avatte Website is designed for users located in the United States, and the laws of the United States govern our collection and use of information. If you access the Avatte Website from outside the United States, please note that your information may be transferred to and processed in the United States or other countries whose data protection laws may differ from those of your home country.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we handle it. If you do not agree with our policies and practices, you may choose not to place an order with us or proceed with the scanning process. By providing your consent, you accept the terms of this Privacy Policy. We may update this Privacy Policy periodically (see Changes to Our Privacy Policy).

Information We Collect About You and How We Collect It

We collect various types of information from and about you, including:
Scan Data: Your 3D personal scan data and/or images.
Personal Information: Information that can personally identify you, such as your name, postal address, email address, telephone number, date of birth, height, other biometric data, payment details, and purchase history.
This information is collected directly from you when you provide it or as we carry out actions necessary to fulfill the purpose for which you provided it (e.g., scanning to produce a Service).

Information You Provide to Us:
‍The information we collect through the Avatte Sites or Avatte Website may include: Information you provide by completing forms and/or placing an order at the Avatte Sites or on the Avatte Website, including your email address. Records and copies of our correspondence. Information you provide when reporting an issue with a service. Details of transactions you conduct with us, including information related to the fulfillment of your orders. You may be required to provide financial details, such as credit card information, before placing an order.

Information We Collect Through Automatic Data Collection Technologies:
As you navigate and interact with the Avatte Website, we may use automatic data collection technologies to gather certain information about your device, browsing activities, and patterns, including: Details of your visits to the Avatte Website, such as traffic data, location data, logs, communication data, and the resources you access and use on the site. Information about your computer and internet connection, including your IP address, operating system, and browser type.
We may also use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). Please note that Avatte does not currently respond to "Do Not Track" signals.

This helps us enhance the Avatte Website and provide a more tailored experience, including by enabling us to: Estimate the size of our audience and understand usage patterns. Store information about your preferences, allowing us to customize the Avatte Website to suit your individual interests. Speed up your searches. Recognize you when you return to the Avatte Website..
The technologies we use for automatic data collection may include: Cookies (or browser cookies): A cookie is a small file placed on your computer's hard drive. You can choose to refuse browser cookies by activating the appropriate setting in your browser. However, if you select this setting, you may not be able to access certain parts of the Avatte Website. Unless you adjust your browser settings to refuse cookies, our system will issue cookies when you visit the Avatte Website. Web Beacons: Pages on the Avatte Website may contain small electronic files known as web beacons (also called clear gifs, pixel tags, or single-pixel gifs). These allow the Company to, for example, count users who have visited certain pages and gather related website statistics, such as tracking the popularity of content and verifying system and server integrity.
We do not automatically collect personal information, but we may link this data to personal information about you that we obtain from other sources or that you provide to us.

How We Use Your Information

We use or may use information that we collect about you or that you provide to us, including any Personal Information: To fulfill or meet the reason you provided the information. For example, if you share your name and contact information to request a price quote or ask a question about our Services, we will use that information to respond to your inquiry. If you provide your Personal Information to purchase a Service, we will use that information to process your payment and facilitate delivery. We may also save your information to facilitate new Service orders. To provide, support, personalize, and develop the Avatte Sites and our Services. To create, maintain, customize, and secure your account with us, and provide you with notices about your account. To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including but not limited to processing your requests, purchases, transactions, payments, and preventing transactional fraud. To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses. To deliver to you content and service offerings relevant to your interests, via email or text message (with your consent, where required by law), and for display and publication on our advertising materials. To help maintain the safety, security, and integrity of the Avatte Sites, Services, databases and other technology assets, and business. For testing, research, analysis, and service development, including the development and improvement of the Services, a portion thereof or any Intellectual Property attached or related thereto. For the sale or licensing of your Scan Data to third parties for such third parties’ testing, research, analysis and service development. To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations. As described to you when collecting your Personal Information or as otherwise set forth under the applicable law. To maintain the safety, security, and integrity of the Avatte Sites, Services, databases, other technology assets, and our business operations. For testing, research, analysis, and service development, including improving the Services or any related Intellectual Property. To help you maintain control, we have implemented the following mechanisms: Tracking Technologies and Advertising: You can configure your browser settings to block all or certain cookies or to notify you when cookies are being sent. Please note that disabling or refusing cookies may affect the functionality of some parts of our site, potentially rendering them inaccessible or not fully operational. Promotional Offers from Avatte: If you prefer not to receive promotional communications from Avatte, you can decline by refraining from clicking the acceptance button for the Terms or proceeding with any transaction (e.g., scanning). Alternatively, you may email us at termsandconditions@Avatte.com to request exclusion from promotional emails. If you receive a promotional email, you can reply requesting to be removed from future distributions. Please note that this opt-out option does not apply to transactional emails related to Service purchases, warranty registrations, or other similar interactions. Third-Party Advertising: We do not oversee third parties' practices for collecting or using your information for interest-based advertising. However, many third parties offer mechanisms to opt out of such data collection. For instance, you can choose not to receive targeted advertisements from members of the Network Advertising Initiative (NAI) by visiting the NAI’s opt-out page.

Accessing and Correcting Your Information

You may contact us at studio@avatte.me to request access to, correction of, or deletion of any Personal Information you have provided to us. While we will review and process such requests, we may deny them to the extent allowed by applicable law. For example, we may not accommodate a request to modify your Personal Information if we believe the change would violate legal requirements or render the information inaccurate. Additionally, we may decline a request for deletion if retaining the information is necessary to comply with applicable laws, regulations, or other legal obligations (e.g., completing transactions), to maintain and improve the functionality and security of the Avatte Sites, or to use the information in a manner consistent with the purpose for which it was originally provided.

Minors

We only scan minors and collect data or information from them with the prior consent of their parent or legal guardian. By providing your consent through the method specified by us, you confirm that you are of legal age and are the parent or legal guardian of the minor being scanned. If we determine, at our sole discretion, that the necessary consent or authority has not been properly obtained, we reserve the right to refuse the scanning process and/or reject any associated order without liability to the Customer.

Children Under the Age of 16

The Avatte Website is not intended for use by children under the age of 16. Individuals under 16 are prohibited from providing any information to or on the Avatte Website. We do not knowingly collect Personal Information (as defined below) from children under 16. If you are under 16, do not use or provide any information on this website, register on the platform, make purchases, or share any details about yourself, such as your name, address, phone number, email, or any screen or username. If we become aware that we have inadvertently collected Personal Information from a child under 16 without verified parental consent, we will promptly delete such information. If you believe we may have collected information from or about a child under 16, please contact us at studio@avatte.me.

Data Security

We have implemented security measures to protect your Personal Information from accidental loss, unauthorized access, misuse, alteration, and disclosure. All information you provide to us is stored on secure servers protected by firewalls, and any payment transactions are encrypted to enhance security. However, please note that the transmission of information over the internet is not entirely secure. While we strive to safeguard your Personal Information, we cannot guarantee its complete security during transmission to the Avatte Website. Any transfer of Personal Information is done at your own risk. Additionally, we are not responsible for any breaches of privacy settings or security measures on the Avatte Website.

Changes to Our Privacy Policy

We reserve the right to amend this privacy policy at our discretion and at any time. When we make changes to this privacy policy, we will post the updated policy at the Avatte Sites or our Order forms and update the date of this privacy policy’s last revision at the top of the page. Your placement of Order(s) or allowing Avatte to scan you constitutes your acceptance of such changes.
